In accordance with Article 10 of the LSSICE, this Legal Notice regulates access and use of the web pages provided by Pequeños y Medianos Astilleros, Sociedad de Reconversión, S.A. (hereinafter, Pymar) at all times, which make up the website www.pymar.com (the “Website”), and which includes the contents and services provided therein. All persons who access the Website (“user”) accept they are subject to the following terms and conditions (the “Conditions of Use”).

The user must read and accept this Legal Notice before accessing and using the Website. If the user does not agree to the Conditions of User, they may not use the Website.

Commitments and obligations of users

The user is informed, and accepts, that accessing and browsing the website is the exclusive responsibility of the user. This way, the user commits to use the Website, its services and contents without contravening the legislation in force, good faith and/or public order. The use of the Website for illicit or harmful purposes or for purposes injurious to same, or that in any way may cause harm to, damage, render inoperable or impede the normal functioning of the Website. With respect to the content of the Website, is prohibited to:

• Reproduction, distribution or modification of all or part without the prior authorisation of Pymar;
• Any violation of the rights of Pymar as legitimate owner;
• Its use for commercial or advertising reasons.

The user shall not impede the access of other users to the Website through the massive consumption of IT resources, nor perform any actions that damage, interrupt or generate errors in these systems.

The user shall introduce or execute programmes, virus, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or may cause any kind of alteration in the IT systems of Pymar or third parties.

In the use of the Website, the user commits not to carry out any conduct that may damage the image, interests or rights of Pymar its member shipyards or third parties.

The User is also aware that the security measures of IT systems on the internet are not completely reliable and, therefore, Pymar cannot guarantee the absence of malware or other elements that may cause alterations in the User’s IT systems (software and hardware) or electronic files and databases contained thereon, despite the fact the Pymar takes all the measures and resources necessary to prevent the presence of these malicious elements.

Security measures

The personal data communicated by the user to Pymar can be stored on automated or non-automated databases, the ownership of which corresponds exclusively to Pymar, which assumes the responsibility to take all the measures of technical, organisational and security nature that guarantee the confidentiality, integrity and quality of information contained thereon in accordance with the provisions of the regulation in force in relation to data protection. The communication between the users and the Website uses a secure channel, and the data transmitted are encrypted thanks to https protocols, therefore Pymar aims to ensure the best security conditions for confidentiality of users to be ensured.

Intellectual and industrial property rights

By virtue of the provisions of Articles 17 and following of the Intellectual Property Law, it is expressly prohibited to reproduce, distribute, publicly disclose, including the format in which they are made available, in full or in part, the contents of this Website for commercial purposes, in any format and by any technical method, without the authorisation of Pymar. The user knows and accepts that the entirety of the website, containing but not limited to the text, software, contents (including the structure, selection, ordering and presentation of same) podcasts, photographs, audio-visual material and graphics, is exclusively owned by Pymar and is protected by trademarks, author’s rights and other legitimate rights, in accordance with international treaties to which Spain has signed up and other property rights and legislation in Spain. Consequently, the user commits to respect the intellectual and industrial property rights of Pymar.

The use of the Website does not imply the concession on the part of Pymar of any transfer to the user regarding their intellectual or industrial property rights or any other right relating to the Website. Therefore, any use in this regard constitutes a violation of the intellectual and/or industrial property rights of Pymar constituting an infraction sanctioned by Law.

In the event that a user or third party considers that there has been a violation of their legitimate intellectual property rights by the entry of specific content on the Website, they should notify Pymar of such circumstances, indicating:

• Personal data of the data subject of the rights allegedly violated or indicate the representation with which they are acting in the event of a complaint submitted by a third party other than the data subject.
• Indicate the contents protected by intellectual property rights and their location on the Website, the accreditation of the intellectual property rights indicated and express declaration that the data subject assumes responsibility for the veracity of the information provided in the notification.

Exclusion of guarantees and data controller

Pymar does not guarantee that the Website and server functions correctly at all times, and therefore is not responsible, under any circumstances, for damages of any nature that may arise from:

• The lack of availability, maintenance and effective functioning of the Website or its services and contents;
• The existence of malware, virus and similar malicious or harmful programmes in the contents;
• The illicit, negligible or fraudulent use contrary to this Legal Notice on the part of the user;
• The lack of legality, quality, reliability, usefulness and availability of the services provided by third parties and made available to users on the Website.

Pymar is not responsible, under any circumstances for any damages that may arise from interference, omissions, interruptions, telephone line malfunctions or disconnections in the operational functioning of this electronic system for reasons beyond the control of Pymar or for delays or blockages in the use of this electronic system due to deficiencies or saturation of telephone lines or overloading on the Internet system, or other electronic systems, nor for damages that may be caused by third parties through illegal interference beyond the control of Pymar.

The hyperlinks contained on the Pymar Website may direct users to third-party websites. Pymar assumes responsibility for the contents, information or services that may appear on such websites, which shall have exclusively informative character and that under no circumstances shall they imply any relation between Pymar and the persons or entities owning such contents or owners of the sites where they are hosted.

Amendment of the Legal Notice

Pymar may amend, update, correct or freely alter this Legal Notice.

The user knows and accepts that it is their responsibility to review this Legal Notice. The continued browsing of this Website after such amendments shall constitute recognition of the amendments to the Legal Notice and shall be bound by the new wording.

Applicable law and jurisdiction

In general, relations between Pymar and the users of the Website shall be governed by the clauses and, where not provided for therein, by Spanish legislation, submitting exclusively to the jurisdiction of the courts of Madrid.
